These terms and conditions outline the rules and regulations for the use of Canary Explore's Website, located at https://canaryexplore.com.

1. Contract between the Customer and the Travel Agency
By booking a trip with Canary Explore, you agree to comply with and be bound by the terms and conditions set forth in this document. Please read these terms and conditions carefully before making any reservations.
2. Reservations and Payments
All bookings are subject to availability.
Payments must be made in accordance with the agency's payment policies.
A non-refundable deposit is required to secure the booking, and full payment must be made before the departure date.
3. Cancellations and Refunds
All cancellations must be made in writing and before 48h before the trip starts.
Refunds are subject to the cancellation policies set by the agency and service providers.
4. Itinerary Modifications
The agency reserves the right to make changes to the original itinerary due to reasons beyond its control, such as adverse weather conditions or unforeseen circumstances.
All reasonable efforts will be made to notify customers of any changes to the itinerary as soon as possible.
5. Customer Responsibility
Customers are responsible for obtaining necessary travel documentation, such as passports and visas.
Customers must comply with all regulations and entry requirements of the destinations visited during the trip.
6. Travel Insurance
All customers are strongly recommended to purchase adequate travel insurance covering cancellations, interruptions, loss of luggage, and medical expenses.
7. Limitation of Liability
The travel agency is not liable for any loss, injury, damage, or expense caused by circumstances beyond its control.
The agency's liability is limited to the amount paid by the customer for the travel services.
8. Consent for Photographs and Videos
Customers agree that the agency may take photographs and videos during the trip for promotional use. If a customer does not wish to be photographed or filmed, they must notify the agency in writing before the start of the trip.
9. Applicable Law
This agreement shall be governed by the laws of Spain, and any dispute related to this agreement shall be subject to the exclusive jurisdiction of the courts of Las Palmas.
10. Customer Conduct
The travel agency reserves the right to decide whether a customer may participate in an excursion if they are under the influence of drugs or alcohol. In such cases, the agency may deny the customer's participation in the excursion without refunding the deposit.
11. Punctuality
Customers must arrive promptly at the designated meeting point for each excursion. The travel agency reserves the right to start the excursion at the scheduled time, even if a customer arrives late. In case of late arrival, the agency will not refund the deposit paid, and the customer will forfeit the opportunity to participate in the excursion.
DISCLAIMER FOR TRAVEL
This document is valid from the date 01/03/2024 and will cover any trips organized by Canary Explore to the Canary Islands:
As a participant in the trip organized by Canary Explore, hereby accept and understand the terms and conditions set forth in this disclaimer document. I acknowledge that I am voluntarily participating in this trip and have been adequately informed about the risks associated with it.
Liability Waiver: I understand and agree that Canary Explore shall not be liable for any accidents, injuries, damages, losses, or any other occurrences that may happen before, during, or after the trip. I acknowledge that travel to the Canary Islands may involve certain inherent risks, such as sudden weather changes, uneven terrain, water activities, and other unforeseeable factors.
Travel Insurance: I acknowledge the importance of having adequate travel insurance to cover potential medical expenses, cancellations, luggage loss, and other unforeseen circumstances. I agree that it is my responsibility to obtain appropriate travel insurance and that Canary Explore shall not be liable for any expenses related to lack of insurance coverage.
Participant's Behavior: I agree to behave responsibly at all times during the trip. I understand that any inappropriate behavior, including but not limited to excessive alcohol consumption, illegal drugs, or disruptive behavior, may result in immediate termination of my participation in the trip, without refund and at my own expense.
Third-Party Liability Waiver: I acknowledge that Canary Explore may contract third-party services, such as tour guides, activity operators, and transportation providers. I agree that Canary Explore shall not be liable for any act or omission by these third parties and that any claims or disputes shall be addressed directly with the respective provider.
Consent for Use of Images: I agree that photographs or video recordings may be taken during the trip in which I may appear. I authorize Canary Explore to use these images for promotional purposes on its website, social media, or other advertising materials.
By booking a trip with Canary Explore, you acknowledge that you have read, understood, and agreed to these Terms and Conditions.
